    Description

    The Ministry of Justice (the "Authority") previously issued two PINs (Prior Information Notices) to initiate market engagement activity to help inform its strategy for the future delivery of Prison Operator Services in England and Wales, beyond the expiry of the current Prison Operator Services Framework (POSF) Agreement in July 2025. (FTS PIN references: 2024/S 000-000092 & 2024/S 000-004241 and Contracts Finder PIN references: tender_366202/1297577 & tender_366202/1312237).

    As expressed in previous PINs, the Authority is keen to invite organisations with the capability and capacity to deliver prison operator services to express their interest in future market engagement activity.

A separate notice(s) will be published at the relevant time should the Authority decide to commence any procurement(s).

    This PIN is for the purpose of initiating further market engagement activity and inform the market of the Authority's intention to deliver a programme of events over the coming months.

    Future market engagement is expected to involve a mixture of in-person and online events, as well as Questionnaires eliciting feedback from the market (however, this is not a commitment and is subject to change). The outputs of this activity will be used to help inform the Authority's strategy to deliver the Second Generation of the Prison Operator Services Framework.

    NEXT EVENT:

    The Authority will be holding an in-person event on Thursday 2nd May 2024 from 10:00 to 16:00 at HMPPS Prison College, Newbold Revel, Rugby, CV23 0TH. There is free parking available on site.

    The event aims to introduce and invite discussion with the market on two important areas for the future of Prison Operator Services:
    - Women in Prison: Unique challenges and circumstances
    - Sustainability in Prison Operator Services

    A maximum of 6 attendees from each organisation may register to attend and there will be an option to join remotely, where required. All communications and details for the event will be shared through Jaggaer.

    Background:
    Prison Operator Services (also referred to as "Prison Management" in global markets) involves the provision of Operational Custodial Services and Facilities Management of prisons in England and Wales. The Authority has tendered the operation of prisons to the private sector since the early 1990s and has long advocated a shared approach to prison operation that includes a mix of public, voluntary and private sector involvement.

    Specifically, a Prison Operator Contract covers delivery of all operational custodial services (including but not limited to education, rehabilitation, training, work, security, resettlement) and FM services (hard and soft) that are required for a prison to hold prisoners securely and maintain the prison to a high standard, while providing transformative services that reduce reoffending. All FM and operational custodial services may be delivered by one supplier, or multiple suppliers may enter partnerships to cover all aspects of delivery.

    The Authority established the Prison Operator Services Framework (POSF) Agreement in 2019 and appointed six Framework Operators who demonstrated that they had the capability, strategy and understanding to deliver Prison Operator Services in new and existing prisons in England and Wales. The objective of the procurement for the framework was to test bidders 'ability to deliver value for money through the right blend of quality, innovation in service delivery, and price in any prison competed under the framework. Some of the benefits that have been delivered to date include:

    - Demonstrating commitment to a clear pipeline of business opportunity by successfully awarding five (5) Call-Off Contracts on time, including during the pandemic at a time of acute pressure on the estate.
    - Enabling the efficient management and delivery of operator competitions for both expiring PFI/Manage& Maintain prison contracts for new build prisons through its streamlined Mini-Competition process, with appointed Framework Operators eligible to compete in further competitions for individual Call-Off Contracts.
    - Maximising bidder participation across all competitions by eliminating conflicts (e.g., overlaps in key market activity across competitions) so bidders do not have to choose which prisons to bid for.

    The current POSF is due to expire in July 2025.
